Terms & Conditions of Sale – Original Artwork

These Terms & Conditions apply to the purchase of any original painting or print sold by the Artist through her website or direct sale. By purchasing an original painting, the Buyer agrees to the following terms:

1. Description of Artwork

Each original painting is a one-of-a-kind, hand-created artwork. Details such as title, medium, dimensions, and date of creation are specific to each piece and may be listed on the website, invoice, or accompanying documentation.

2. Transfer of Physical Ownership Only

Upon full payment, ownership of the physical original painting is transferred to the Buyer. No other rights are transferred.

3. Copyright & Intellectual Property

The Artist retains all copyrights and intellectual property rights to the Artwork, including but not limited to: – All copyright and moral rights – The right to create prints, reproductions, and digital versions – The right to use images of the Artwork for promotion, marketing, sale, publication, or licensing – The right to create derivative works or similar-looking works – The right to sell or license reproductions in any format, now or in the future

The Buyer may not reproduce, scan, photograph for commercial use, distribute, or sell images of the Artwork without prior written permission from the Artist.

4. Buyer’s Permitted Rights

The Buyer is granted the following limited rights: – Ownership of the physical original painting – The right to display the Artwork in private or public spaces (home, office, gallery) – The right to resell the physical original painting, provided these Terms & Conditions are included with any resale

5. No Alteration or Modification

The Buyer agrees not to: – Alter, modify, crop, or damage the Artwork – Digitally manipulate, scan, or reproduce the Artwork – Allow third parties to alter or reproduce the Artwork

6. Attribution

If the Artwork is displayed publicly or shared online by the Buyer, credit must be given as:

“Artwork by Missy”

or another credit line approved in writing by the Artist.

7. No Commercial Use Without Permission

The Artwork may not be used for commercial purposes, including merchandise, advertising, NFTs, or promotional materials, without express written consent from the Artist.

8. Entire Agreement

These Terms & Conditions constitute the entire agreement between the Artist and the Buyer and supersede all prior discussions or agreements. Any amendments must be made in writing by the Artist.

9. Acceptance of Terms

Purchase, possession, or display of the Artwork constitutes acceptance of these Terms & Conditions.
